By signing below, I agree to the fact that participation can cause any harm or injury to me. I release the organization(s) or business(es) named above from all liability, costs and damages which could arise from participation in the above-named event or activity. I agree to accept financial responsibility for the costs related to this emergency treatment and give my confirmation of the same by signing this document.

THIS IS A RELEASE OF LEGAL RIGHTS – READ AND UNDERSTAND BEFORE SIGNING.

Section 1: Assumption of Inherent Risk and Consent Form

1. Inherently Dangerous Risks. I understand that in any workshop or activity on the Ore Metals Studio. I may use inherently dangerous tools, equipment, machines, chemicals or substances. I agree that I will attend any required safety orientation at the beginning of my workshop, and I will not use equipment or materials without familiarizing myself with their safe use. I will educate and inform myself on the inherent dangers and risks that are associated with participation in that workshop. Risks of this nature could lead to illness, serious injury or even death. I have made my own investigation and am willing to accept these risks.

2. Health and Safety. I am aware that my own behavior can affect my personal safety and the safety of others involved in Ore Metals Studio workshops and activities. I will act according to Ore Metals Studio and MOTHER BROOK ARTS AND COMMUNITY CENTER (MBAC) policies, other applicable guidelines and information presented. I understand that failure to comply may result in my dismissal from Ore Metals Studio, at its discretion and my expense.

COVID-19 Statement - In light of the ongoing COVID-19 pandemic, I am aware that any public activity carries risk of illness. Ore Metals Studio is following all applicable guidelines from the Centers for Disease Control and Prevention, the State of Massachusetts and local health authorities and I agree to follow all health and safety guidelines during my time on the studio. Nevertheless, despite all reasonable precautions, I accept and personally assume the risk that by participating in any of Ore Metals Studio programs I may be exposed to the virus that causes COVID-19.

3. Assumption of Risk and Release of Claims. Knowing the risks described above, I agree, on behalf of myself, my family, heirs, and personal representative(s), to assume all risks and responsibilities surrounding my participation in such programs. To the extent permitted by law, I release and indemnify Ore Metals Studio and MB its officers, employees and agents, from and against any present or future claim, loss or liability for injury to person or property which I may suffer, up to and including death, or for which I may be liable to any other person, during my participation at Ore Metals Studio.

Section 2: Unacceptable Behavior Policy

Ore Metals Studio reserves the right to dismiss any program participant, without notice or refund, for behavior that is disruptive to the community learning and living environment. Ore Metals Studio may refuse admission to anyone with a past history of unacceptable behavior.

Unacceptable behavior includes, but is not limited to, the following:

● Possession/use of alcohol in the studios; intoxication in the studios, underage drinking or providing alcohol to anyone under age 21 or excessive drinking.

● Non-participation in a program if this adversely impacts the learning experience of others.

● Use, possession, or sale of illegal drugs or drug paraphernalia.

● Verbal abuse and/or harassment.

● Hazing, bullying, physical abuse, physical violence or threat of physical harm.

● Sexual assault, abuse, harassment, or indecent exposure.

● Discriminatory or bigoted conduct, including speech, directed at a particular person based on race, gender, gender identity or expression, sexual orientation, religion, age, national origin, or disability.

● Possession, open or concealed, of a deadly weapon on Penland premises.

● Disruption of the normal functioning of the Penland community, breaching the peace, disrupting the work of others,

violating the rights of others.

● Damage to, destruction, theft, or other misuse of Penland property or the property of others.

● Unauthorized use of Penland studios, housing, or other property.

● Behavior which violates local, state, or federal laws.

● Behavior which jeopardizes the safety of self or others.

By signing this document, I acknowledge I have received, read, and understand Ore Metals Studio's Assumption of Inherent Risk and Consent, Diversity & Inclusion Statement, and the Unacceptable Behavior Policy. I have carefully read this form, have been given the opportunity to ask questions and fully understand its contents. No representations, statements, or inducements, oral or written, apart from this form, have been made. My agreement to the provisions in this form is voluntary. I am aware that this is a release of liability and a binding contract between myself and Ore Metals Studio, and I sign it of my own free will. This agreement will become effective on its receipt by Ore Metals Studio and will be governed by the laws of the State of Massachusetts. To the extent any provisions of this document are found to be invalid, all other provisions within this agreement shall remain in effect.

If a program participant is under 18: I am the parent or legal guardian of the above applicant. I have read the foregoing Consent Form, and I am and will be legally responsible for the obligations and acts of the applicant as described in this form, and agree, for myself and for the applicant, to be bound by its terms.

CLASS REGISTRATION

All classes have enrollment limits as listed in class descriptions. Ore reserves the right to cancel classes in the event the minimum number of students for the class is not reached. Ore may also cancel classes in the event of an emergency such as illness, weather, or other unforeseen circumstances. Any canceled class may be rescheduled, should the Instructor and space be available.

CLASS WITHDRAWALS

Students may withdraw from a class up to 72 hours prior to the start of the class and will be given a full refund. Should you request a withdrawal from a class between 24 – 72 hrs before the start of the class, you will receive a 50% refund minus a $10 processing fee. No refunds are offered for same-day (24 hours before the start of a class) withdrawals or for any class already in progress.

There are no refunds, transfers, make-ups, or deferments for missed classes. Instructors may arrange a private session at their shop rate for a make-up class at their discretion.

CLASS CANCELLATIONS

Ore reserves the right to cancel or reschedule classes due to weather, low enrollment, or other considerations. Communication for canceled and rescheduled classes is sent via email from Ore. No refunds are given for changes to Instructor.

Weather and Emergency Closures: If the city of Boston has declared a snow emergency (see: https://www.boston.gov/departments/311/snow-emergency-parking), we are closed to students and/or the public. Closures will be posted on the front page of our website and you should receive an email about class cancellations and/or rescheduling.

PHOTO POLICY

We may occasionally take pictures of students in our classes for use in promotional materials, for use online, and on social media. Your enrollment in a class indicates your approval for this.

MATERIALS FEE POLICY

All materials fees are listed in the course description. Please be sure to bring cash or a check with the amount listed to the Instructor. Your Instructor may also accept Venmo and will indicate this in an email prior to the class.

HOW TO PREPARE FOR AN UPCOMING CLASS

What to Wear:

Closed-toed shoes, shop-appropriate clothing (natural materials and long pants for welding, no loose or dangly clothes or accessories, long hair tied back if necessary)

Basic protective gear is provided (safety glasses and gloves, ear protection) but we encourage you to invest in your own if you’re going to be doing regular shop work. If you have allergies or are sensitive to dust, we encourage you to bring your own work mask.
